Texas Anti-Dildo Law Struck Down

Houston Chronicle reporting...

... and this news was big enough to make national news via the Associated Press.

Quote from the 2-1 decision:

Just as in {Lawrence v. Texas, the Supreme Court case that struck down Texas's law banning gay sex}, the state here wants to use its law to enforce a public moral code by restricting private intimate conduct... This case is not about public sex. It is not about controlling commerce in sex. It is about controlling what people do in the privacy of their own homes because the state is morally opposed to a certain type of of consensual private intimate conduct.

Barring appeal, this takes Texas off the list of states that ban sex toys- leaving only Alabama, Mississippi, and Virginia.

Yet another victimless crime goes by the boards... that is, unless the state decides to appeal to the full Fifth Circuit bench.
